Terms of Use

These Terms of Use govern your access to the MarKit website and product. By accessing or using MarKit, you agree to these terms.

Early-access product

MarKit is an early-stage product. Features may be incomplete, change, become temporarily unavailable, or be discontinued as we test and improve the experience.

We may invite, limit, or pause access during the early-access period.

Eligibility and accounts

You must be at least 18 years old and legally able to accept these terms. You are responsible for the accuracy of information you provide and for activity under your account.

Keep your authentication credentials secure and notify us if you believe your account has been accessed without permission.

Acceptable use

Do not use MarKit unlawfully, infringe others' rights, attempt unauthorized access, interfere with the product, distribute harmful code, or use automated methods that place an unreasonable load on our systems.

You are responsible for ensuring that your marketing activity and content comply with applicable law, platform rules, and advertising requirements.

Your materials and permissions

You retain the rights you hold in your business materials, including text, photos, logos, and other supported media. Providing materials to MarKit does not transfer ownership of them to us or change the rights of third parties.

You give MarKit a limited permission to host, process, reproduce, analyze, select, edit, transform, and generate marketing content from materials you upload, make available through a connection you authorize, or ask us to obtain from specified websites or other sources, including your business website. MarKit acts on your behalf and for your business. This permission extends to our service providers, including AI providers, only as needed to provide and secure the marketing services you request.

You confirm that you are authorized to represent the business and have all necessary rights, licenses, and consent for these uses, including rights in text and logos, the photographer’s rights, and consent covering commercial use and transformation of any identifiable person’s image. Public availability alone does not establish permission, and accepting these terms does not grant rights you do not hold.

You remain responsible for reviewing factual accuracy, people’s depictions, and permissions before using or approving content. Permission to create or transform materials is separate from permission to publish them: publication through MarKit continues to require your approval.

MarKit product ownership

MarKit and its licensors retain their rights in the platform, software, brand, interface design, and reusable product resources. These rights are separate from your business materials and the marketing outputs generated for you.

Artificial-intelligence outputs

MarKit uses artificial intelligence to generate suggestions and draft materials. Outputs may be incomplete, inaccurate, or unsuitable for your circumstances.

As between you and MarKit, to the extent permitted by applicable law, you own the marketing outputs generated for you. MarKit assigns to you any rights it holds in those outputs. This does not transfer third-party rights or guarantee copyright protection, exclusivity, or uniqueness; other users may receive similar outputs.

You are responsible for reviewing outputs before relying on, publishing, or acting on them. MarKit does not provide legal, financial, tax, or other regulated professional advice.

Availability and warranties

MarKit is provided on an "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted access, specific marketing results, revenue, audience growth, or the accuracy of generated outputs.

Liability and suspension

To the fullest extent permitted by law, MarKit will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the product.

We may suspend or end access when necessary to protect MarKit or others, address misuse, comply with law, or operate the early-access program.

Changes and contact

We may update these terms as MarKit develops. Continued use after an update means you accept the revised terms.
